House and Usage Regulations
§ 1 Scope
(1) The following provisions apply to contracts concerning the use of the services offered by Badewelt Sinsheim GmbH (hereinafter referred to as 'BSG') by its guests at THERMEN & BADEWELT SINSHEIM.
(2) Any special agreements between BSG and the town of Sinsheim or third parties shall not be affected by the following provisions. Unless special agreements concluded by BSG with the town of Sinsheim or third parties expressly stipulate otherwise, the provisions of these House Rules and Terms of Use shall remain unaffected.
(3) THERMEN & BADEWELT SINSHEIM comprises the publicly accessible reception area (hereinafter referred to as the 'Foyer') and the physically separate building complexes 'Sportbad', 'Palmenparadies' and 'Vitaltherme & Sauna' (hereinafter referred to as the 'building complexes').
§ 2 Visits to THERMEN & BADEWELT SINSHEIM
(1) Without prejudice to paragraphs (2) and (3) below, the following persons are not permitted to enter [...] for reasons of infection control:
a) Persons who are subject to a requirement to self-isolate;
b) persons who do not meet the requirements arising from the applicable laws, regulations, general decrees or orders in individual cases, or who are unable or unwilling to provide proper proof of these requirements.
(2) Entry to the 'Foyer' is permitted only to persons who intend to enter into a contract with BSG. The same applies to persons who bring other persons (e.g. children) to THERMEN & BADEWELT SINSHEIM for this purpose or collect them from there, as well as to persons who visit THERMEN & BADEWELT SINSHEIM by invitation or on the basis of special permission from BSG. Staying on the premises for any other purpose is not permitted.
(3) Entry to the building complexes is permitted only during opening hours (§ 5) and only to guests who hold the relevant access authorisation (§ 3).
§ 3 Conclusion of Contract, Access Authorisation, Age Restrictions
(1) The contracting parties are BSG and the guest.
(2) A contract between BSG and the guest is only concluded once BSG has accepted the guest's offer. Acceptance of the offer takes place when the cashier issues the guest with access pass in the form of a transponder upon presentation of a valid online ticket. The guest is obliged to return the transponder issued to them before leaving THERMEN & BADEWELT SINSHEIM.
(3) BSG shall only accept offers from guests provided that the following age restrictions do not preclude this:
a) 'Sportbad'
Children under the age of 10 are only granted access to the 'Sportbad' on condition that they are accompanied by a parent or an adult supervisor.
b) 'Palmenparadies'
Access to the 'Palmenparadies' is generally restricted to persons aged 16 and over. Children up to the age of 4 are permitted access to the 'Palmenparadies' if they are accompanied by a parent or an adult supervisor. Children and young people aged between 5 and 15 are only permitted access to the 'Palmenparadies' on special promotional days, whether held regularly or irregularly; otherwise, they are not permitted access.
c) 'Vitaltherme & Sauna'
Access to the nudist 'Vitaltherme & Sauna' is granted exclusively to persons aged 16 and over.
Paragraph (4) remains unaffected.
(4) The guest has no right to expect BSG to accept their offer to enter into a contract. BSG reserves the right to reject the offer on operational grounds (e.g. due to excessive visitor numbers) or for other objective reasons. An 'other objective reason' exists, in particular, where, based on the specific circumstances of the individual case, there is reason to fear that the guest
a) will breach the following provisions;
b) as a result of their physical, mental or other condition, would endanger themselves or others during their stay at THERMEN & BADEWELT SINSHEIM. In the event that BSG does not accept the guest's offer, it shall refund the amount paid for the online ticket.
§ 4 Prices, Access to Other Areas
(1) In return for access to the building complexes, BSG charges admission fees of varying amounts, depending on the diversity of the respective range of services. The admission fee payable also depends on which tariff the guest selects or which tariff applies at the time the contract is concluded, depending on the time of day, the day of the week or
other circumstances. If the relevant tariff stipulates a limited duration of stay, exceeding this limit will result in an increase in the admission fee. The current tariffs and the respective admission fee are displayed on screens above the ticket counters.
(2) Admission to the 'Palmenparadies' includes admission to the 'Sportbad'. Admission to the 'Vitaltherme & Sauna' includes admission to the 'Palmenparadies' and the 'Sportbad'. The building complexes are interconnected in such a way that passageways allow access from the 'Sportbad' to the 'Palmenparadies' and from the 'Palmenparadies' to the 'Vitaltherme & Sauna'. Within the scope of the existing admission entitlement, an unlimited number of transfers from one building complex to another are permitted.
Paragraph (3) applies to entry into a building complex to which the access authorisation does not yet extend at the time of entry.
(3) The access authorisation granted to a guest upon conclusion of the contract in accordance with Section 3(3) may be extended in accordance with the following provisions:
1. Guests with access authorisation for the "Palmenparadies" are free to enter the "Vitaltherme & Sauna" for a fee;
2. Access must be gained exclusively via the designated passages.
3. The provision of these passages constitutes an offer by BSG to guests of the 'Palmenparadies' to amend the existing contract between them such that the guest's access authorisation is extended to cover the 'Palmenparadies' building complex or 'Vitaltherme & Sauna'; § 3(4) and (5) apply to BSG's offer mutatis mutandis.
4. By passing through a passageway, the guest accepts BSG's offer. Through this amendment to the contract, the guest undertakes to BSG to pay an increased admission fee, which must be paid at the ticket office before leaving the THERMEN & BADEWELT SINSHEIM at the ticket office. The additional admission fee to be paid consists of the difference between the admission fee already paid and the admission fee payable for the building complex into which the chargeable transfer was made, in accordance with the tariff applicable to that building complex.
5. Any additional admission fee payable by the guest shall be determined exclusively in accordance with the rate applicable to the building complex into which a chargeable transfer took place. In the event of a transfer from the "Palmenparadies" to the "Vitaltherme & Sauna", only the rate applicable to the "Vitaltherme & Sauna" shall apply. No pro-rata calculation of the rate will be made, taking into account the length of stay in different building complexes before and after one or more paid transfers.
(4) The right of access is non-transferable. It is not permitted to make the right of access available to another guest, whether for a fee or free of charge, for their use, or to have the right of access of another guest made available to you, whether for a fee or free of charge, for your use. Making the right of access available for use occurs when possession of the access authorisation is transferred in order to enable oneself or another guest, in breach of the contract, to use a building complex without paying the admission fee required by BSG for this purpose. Violations will be prosecuted under criminal and civil law.
§ 5 Opening Hours
The BSG announces the opening hours via notices.
§ 6 BSG's contractual obligations
Under the terms of the contract, BSG undertakes to grant the guest the opportunity to make use of the range of services within the relevant building complex, subject to the guest's access authorisation. This right of use extends to the areas, facilities and amenities designated for guest use, provided that these are not temporarily closed by BSG for operational or other objective reasons, or are not available to the guest in a specific instance due to the exhaustion of their spatial capacity or numerical quota.
§ 7 General contractual obligations of the guest
(1) Under the terms of this contract, the guest undertakes to pay BSG the agreed admission fee for the selected building complex. The guest further undertakes to pay BSG any surcharges for
a) entry to another building complex subject to a charge,
b) exceeding the permitted duration of stay as set out in the tariff, or
c) the use of other additional services subject to a charge (such as food or drinks).
(2) Under the terms of the contract, the guest undertakes to
a) carry their admission pass
aa) with them at all times; Date: 11 November 2023
bb) present it to BSG staff and its other agents upon entering a building complex, as well as upon request at any time, and, where necessary, hand it over for inspection purposes;
b) to treat the premises, facilities and equipment of THERMEN & BADEWELT SINSHEIM with care and respect and not to contaminate them;
c) to behave in such a way that he
aa) does not endanger either himself or others;
bb) does not harass, disturb or offend the sense of propriety of other guests. They must refrain from any behaviour that is deemed inappropriate in accordance with social rules and customs;
d) to observe the signposted warnings and other behavioural guidelines issued by BSG;
e) in connection with their visit to THERMEN & BADEWELT SINSHEIM;
f) for hygiene reasons, to wash in the designated shower rooms after removing their street clothing;
g) not to commit any criminal offences or administrative offences to the detriment of other guests or BSG. Should BSG become aware of circumstances giving rise to a suspicion that a guest at THERMEN & BADEWELT SINSHEIM has committed a criminal offence or administrative offence, it shall report these circumstances to the competent authority. This shall not affect any further action taken by BSG against the person suspected of having committed a criminal offence or administrative offence at THERMEN & BADEWELT SINSHEIM.
§ 8 Prohibitions
(1) Guests are prohibited from engaging in sexual acts on themselves or on other guests at THERMEN & BADEWELT SINSHEIM, or from allowing other guests to engage in sexual acts on them.
(2) Guests are not permitted to bring into THERMEN & BADEWELT SINSHEIM drinks or food of any kind (including sweets), to consume them, or to consume drinks or food brought in by other guests. This prohibition does not apply to food and drink
a) which a guest is dependent on for medical or other reasons, or (e.g. as a result of allergies or food intolerances) is restricted to;
b) which is objectively intended for newborns, infants or young children (such as bottled milk, jarred baby food, porridge). The BSG undertakes to provide guests with drinks, food and luxury foodstuffs and to offer them at reasonable prices. The reasonableness of the prices is assessed on the basis of whether they are in line with market rates in the catering industry.
(3) Guests are not permitted to bring into THERMEN & BADEWELT SINSHEIM or carry on their person the following:
a) Narcotic drugs of any kind, with the exception of prescription medicines that have been prescribed to the guest by a doctor;
b) Containers made of glass, porcelain, ceramics or other breakable materials; if food or drink is served to the guest in such containers at one of the catering outlets at THERMEN & BADEWELT SINSHEIM, these may only be used for their intended purpose and only within the respective catering outlet;
c) animals; for hygiene reasons, this prohibition also applies to animals whose purpose is to compensate for disadvantages arising from a person's physical or mental condition (e.g. guide dogs);
d) Knives or other dangerous objects; dangerous objects are defined as all tools and materials which, given their material, composition and/or other characteristics, are capable of being
aa) used against a person in such a way as to cause significant injury (e.g. screwdrivers, hammers, truncheons, baseball bats); if a knife is made available to a guest in one of the catering establishments at THERMEN & BADEWELT SINSHEIM, it may only be used for its intended purpose and only within the respective catering establishment;
bb) to cause harm to a person's physical integrity (e.g. corrosive liquids).
(e) The use of smart glasses is generally prohibited.
(4) Smoking is not permitted outside the designated areas. The smoking ban also extends to the use of all types of so-called electronic cigarettes.
(5) Unless prior written authorisation has been obtained from the BSG, it is not permitted within the THERMEN & BADEWELT SINSHEIM
a) to display, affix or distribute advertising leaflets, flyers, printed matter or similar items;
b) to carry out activities intended to serve the commercial interests of the guest or a third party;
c) to hold meetings or to call for such meetings;
d) to carry out activities aimed at disseminating political, religious or ideological beliefs or serving the purpose of political decision-making;
e) to organise petition or fundraising campaigns.
(6) Guests are prohibited from taking photographs or filming in all sauna, changing room, shower and toilet areas of THERMEN & BADEWELT SINSHEIM. This absolute ban on photography and filming applies to all devices (e.g. smartphones, smart glasses, action cameras, drones). In the Palmenparadies and Sportbad areas, filming and photography may only take place with the express consent of the people being photographed or filmed. This also includes people who are recognisable in the background. The use of electronic devices in the water areas is prohibited.
§ 9 Duty of supervision
(1) Parents are responsible for supervising their child. This duty is not waived by the fact that the BSG, as part of its duty to ensure public safety, employs staff whose role is to identify and avert dangers. Throughout the entire duration of their stay at THERMEN & BADEWELT SINSHEIM, parents are responsible for ensuring that their children do not come to any harm. Furthermore, parents must ensure that their children do not contravene the provisions of these House Rules and Terms of Use.
(2) The obligations set out in paragraph (1) above also apply to any person to whom a child has been entrusted for supervision during a visit to THERMEN & BADEWELT SINSHEIM.
§ 10 Use of wardrobes and lockers; storage of valuables
(1) The BSG provides guests, free of charge, with wardrobes for storing their clothing and lockers for the storage of any valuables. The
locking mechanism of the wardrobes is activated and deactivated by holding the transponder against the lock cylinder. The lockers are designed in such a way that they can be opened and locked with a key.
(2) The BSG shall make reasonable efforts to prevent the forcible opening of cupboards and lockers by unauthorised persons. Given their design and intended purpose, the cupboards and lockers are not constructed in such a way as to withstand attempts at forced opening with sufficient security. In their own interests, guests should therefore refrain from placing valuables in cupboards or lockers.
(3) It is the guest's responsibility, by exercising the due care required in such matters, to ensure that unauthorised persons do not gain possession of the transponder or key provided to them for the locker or cupboard they are using, and thereby gain access to the contents of the locker or cupboard.
(4) In the event that the guest suffers damage in connection with the opening of cupboards or lockers by an unauthorised person, BSG's liability shall be governed by Section 14.
§ 11 Video Surveillance
Video surveillance is in operation in the lockers area and in other areas of THERMEN & BADEWELT SINSHEIM. This is indicated once again at the relevant locations by signs, which also provide the information required under data protection law.
§ 12 Breaches of the House Rules and Terms of Use; Provision of Personal Details
(1) If a guest breaches any provision of the House Rules and Terms of Use, the BSG, taking into account all the circumstances of the individual case – in particular the nature, severity and duration of the breach, as well as its consequences – is entitled to exclude the guest from further use for the remainder of that day and to expel them from THERMEN & BADEWELT SINSHEIM.
(2) If, on the basis of objective facts, there is a risk that a guest will breach the provisions of the house rules and terms of use in the future, the BSG is entitled to exclude the guest from using the facilities for a longer period (hereinafter referred to as a 'ban'). The duration of the ban shall be determined by the BSG at its reasonable discretion. The BSG shall hear the guest's side of the matter before imposing a ban.
(3) In the event of a breach of the house rules or a suspicion of such a breach based on factual evidence, the guest shall provide the BSG
with their personal details (surname, first name, address for service) and shall provide proof of identity by means of appropriate documents (e.g. identity card, driving licence). A copy of the documents shall not be made.
(4) The guest shall also provide proof of identity in accordance with paragraph (3) above and provide the BSG with the details specified therein if the BSG has a legitimate interest in obtaining such details. Such a legitimate interest exists in particular where these details are necessary for the assertion, exercise or defence of rights or claims of the BSG.
§ 13 Liability of the Guest
If the guest breaches an obligation arising from the contractual relationship established between them and BSG, they shall be liable to BSG for damages in accordance with the statutory provisions. The same applies to breaches of duty by persons for whom the guest is legally responsible.
§ 14 Liability of BSG
(1) BSG shall be liable to the guest in accordance with the statutory provisions for damage to life, limb and health resulting from a culpable breach of duty by BSG, its legal representatives or its vicarious agents. Furthermore, BSG shall be liable to the guest in accordance with statutory provisions for any other damage resulting from intentional or grossly negligent breaches of contract by BSG, its legal representatives or its vicarious agents.
(2) If damage results from a breach of a material contractual obligation due to simple negligence – that is, an obligation the fulfilment of which is essential for the proper performance of the contract and on the observance of which the guest, as BSG's contractual partner, may reasonably rely – BSG's liability shall be limited to the damage that was foreseeable at the time the contract was concluded and is typical of the contract. The same applies where the guest is entitled to claims for damages in lieu of performance.
(3) In all other respects, BSG shall not be liable to the guest for damages.
§ 15 Final Provisions
Should any individual provisions of these House Rules and Terms of Use be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
